I am currently a senior and in my government class we have simulated elections and im running against a Democrat and Republican. That isn't how it works in Britain. That is how it works here in the USA. Any state is free to do a great number of things such as your example of abolishing the death penalty. In fact, there are a number of states that currently do not practice capital punishment.

Our governments have that power through the voters and enough separation that such rulings don't go too far and affect other states where those voters might feel differently. Thats the beauty of our system over some failed fascist ideal.
